This Privacy Policy is linked to both the  Regulations and the DeLaMer consulting services L.L.C-FZ Operators Regulations (hereafter referred to as the "Regulations"). Definitions of terms used in this Privacy Policy are provided in the Regulations and its provisions shall apply accordingly. The purpose of this policy is to inform users about their data protection rights and fulfil the obligations of data controllers under the GDPR, which is the Regulation 2016/679 of 27 April 2016 governing the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC.

 

 

1. PERSONAL DATA ADMINISTRATOR

 

1.1. The data controller for personal data, including the personal data of Users and End Users, is DeLaMer consulting services L.L.C-FZ with its registered office located at Dubai, UAE.

1.3. DeLaMer consulting services L.L.C-FZ has also appointed a Data Protection Officer who can be contacted by writing to info@delamer.ae.

 

 

2. METHOD OF DATA PROCESSING

 

2.1. The Service Provider will process personal data based on the scope of consents given by Users and End Users, as well as additional information provided through appropriate forms.

 

2.2. The processed personal data may include name, surname, email address, telephone number, geolocation data, tax identification number, business address (in the case of business activities), Facebook and Google Plus usernames for logins.

 

2.3. Anonymity cannot be maintained while using DeLaMer consulting services L.L.C-FZ's services.

 

2.4. Personal data of Users and End Users will be processed for the following purposes:

 

2.4.1. Complying with legal provisions - the legal basis for this processing is the authorization granted by law to process data necessary to comply with the law (Article 6(1)(c) of the GDPR).

 

2.4.2. Performing the Agreement and providing Services - the legal basis for this processing is the authorization granted by law to process data necessary for the performance of the contract, when the data subject is a party to it or when it is necessary to take action before concluding the contract at the request of the data subject (Article 6(1)(b) of the GDPR).

 

2.4.3. Addressing complaints and optimizing DeLaMer consulting services L.L.C-FZ's services - the legal basis for this processing is the legitimate interest pursued by DeLaMer consulting services L.L.C-FZ (Article 6(1)(f) of the GDPR) consisting in the proper conduct of business activity.

 

2.4.4. Promotional and commercial activities conducted by DeLaMer consulting services L.L.C-FZ - the legal basis for this processing is the legitimate interest pursued by DeLaMer consulting services L.L.C-FZ  (Article 6(1)(f) of the GDPR) or voluntary consent to the extent it has been expressed (Article 6(1)(a) of the GDPR).

 

2.5. Personal data of persons other than Users and End Users will be processed for the following purposes:

 

2.5.1. Responding to inquiries or receiving complaints - the legal basis for this processing is the legitimate interest pursued by DeLaMer consulting services L.L.C-FZ (Article 6(1)(f) of the GDPR) consisting in the proper conduct of business activity.

 

2.5.2. Cooperating with business contractors - the legal basis for this processing is the authorization granted by law for processing necessary for the performance of the contract, when the data subject is a party to it or when it is necessary to take action before concluding the contract at the request of the data subject (Article 6(1)(b) of the GDPR).

 

2.6. Providing personal data is voluntary, but failure to provide consent to process personal data marked as mandatory in the form will prevent DeLaMer consulting services L.L.C-FZ from providing Services or a response.

 

2.7. If DeLaMer consulting services L.L.C-FZ receives information about a User's or End User's unauthorized use of the Services in violation of the Regulations or applicable regulations, the Service Provider may process the User's or End User's personal data to the extent necessary to determine the scope of its responsibility.

 

2.8. Personal data, especially data of Users and End Users, will be processed for the following periods:

 

2.8.1. Appropriate for DeLaMer consulting services L.L.C-FZ to demonstrate the proper performance of its obligations, with this time period corresponding to the length of the limitation period for claims.

 

2.8.2. In the case of paid Services, for the period required by accounting regulations.

 

2.8.3. In the case of marketing activities, until the person concerned objects to further processing of their personal data for marketing purposes or until consent to the sending of such messages is revoked.

 

2.9. After the above-mentioned periods, personal data will be deleted, unless their processing is necessary on the basis of another legal basis.

 

 

3. DATA RECIPIENTS

 

3.1. To fulfil its obligations and serve Users and End Users, DeLaMer consulting services L.L.C-FZ may share personal data with third-party processors such as hosting providers, IT service companies, CRM service providers, email operators, invoice management system providers, payment operators, accounting offices, and tax and law firms.

 

3.2. DeLaMer consulting services L.L.C-FZ may also disclose personal data collected to relevant state authorities or other entities as required by law.

 

3.3. Each third-party processor with access to personal data is required to sign a personal data processing agreement (the "Entrustment Agreement") and maintain an appropriate level of security and confidentiality. Any processing of personal data by a third-party processor must be authorized by DeLaMer consulting services L.L.C-FZ in advance.

 

3.4. Unauthorized disclosure of personal data, as defined in this Privacy Policy, requires the data subject's prior consent.

 

 

4. RIGHTS OF THE DATA SUBJECT

 

4.1. The User has the following rights:

 

(a) to have their personal data deleted from both DeLaMer consulting services L.L.C-FZ's system and the databases of entities that cooperate or have cooperated with the Service Provider by contacting the Personal Data Administrator or using the appropriate function on their account,

 

(b) to limit data processing,

 

(c) to receive their personal data collected by DeLaMer consulting services L.L.C-FZ in a structured form and transfer it to another data controller,

 

(d) to request access to and rectification of their personal data by DeLaMer consulting services L.L.C-FZ,

 

(e) to object to the processing of their personal data,

 

(f) to withdraw their consent to the processing of their personal data by DeLaMer consulting services L.L.C-FZ at any time without affecting the lawfulness of processing based on consent before its withdrawal.

 

 

5. OTHER DATA

 

5.1. DeLaMer consulting services L.L.C-FZ may store http queries, which means that some information related to the User's activity on the platform may be stored in server log files. This includes the IP address of the computer/device used by the User to access the platform, the name of the User's station, system date and time of registration on the Platform, incoming inquiries, the number of bytes sent by the server, the URL address of the page previously visited by the User, information about the User's browser, and information about errors that occurred during the http transaction. The logs are collected to ensure proper administration of the Platform and only authorized IT administrators have access to the information. The log files may be analysed to compile traffic statistics and identify errors, but the information is presented in a way that does not identify the User.

 

 

6. SAFETY

 

6.1. The Service Provider takes necessary technical and organizational measures to ensure protection of personal data from unauthorized disclosure, removal, processing, change, loss, damage, or destruction. User and End User data is stored on a secured server and protected by DeLaMer consulting services L.L.C-FZ's internal procedures for personal data processing and information security policy.

 

6.2. DeLaMer consulting services L.L.C-FZ has implemented appropriate technical and organizational measures, such as pseudonymisation, to comply with GDPR data protection principles and safeguard data subject rights. DeLaMer consulting services L.L.C-FZ ensures increased protection and security of User's personal data processing by implementing necessary technical measures specified in GDPR Articles 25, 30, 32-34, and 35-39.

 

6.3. DeLaMer consulting services L.L.C-FZ acknowledges that the use of the Internet and electronic services may expose User's device and personal data to malware and unauthorized access by third parties. To minimize these risks, User or End User should use appropriate technical security measures, such as up-to-date anti-virus programs or identification protection programs. DeLaMer consulting services L.L.C-FZ recommends seeking advice from specialized IT service providers for detailed information on maintaining Internet security.

 

 

7. COOKIES

 

7.1. To ensure proper functioning of the Platform, the Service Provider utilizes cookie technology which involves the storage of information packages on the User's device through the Platform. These packages contain website address, date of placement, expiry date, unique number, and other information relevant to the purpose of the file.

 

7.2. Two types of cookies are used by the platform: (a) session cookies, which are permanently deleted at the end of the User's browser session, and (b) persistent cookies, which remain on the User's device after the browser session has ended until they are deleted.

 

7.3. The use of cookies, whether session or persistent, does not enable the identification of the User. Cookies are unable to download any personal data.

 

7.4. Cookies used by the Platform are safe for the User's device and do not allow the entry of viruses or other malicious software.

 

7.5. Cookies generated by DeLaMer consulting services L.L.C-FZ cannot be accessed by other services, whereas external cookies placed by third-party entities may be read by their respective servers.

 

7.6. Users have the freedom to change cookie settings at any time via their web browser or service configuration to specify the conditions of their storage.

 

7.7. The User may choose to disable cookies from being stored on their device in accordance with the instructions provided by the browser manufacturer. However, this may result in the unavailability of certain Platform functions.

 

7.8. The User may also delete cookies stored on their device independently by following the instructions provided by the browser manufacturer.

 

7.9. DeLaMer consulting services L.L.C-FZ uses its own cookies for various purposes such as authenticating the User on the Platform, maintaining their session, configuring the Platform, adapting content to the User's preferences or behavior, conducting analysis and audience research, and monitoring website navigation.

 

7.10. DeLaMer consulting services L.L.C-FZ uses external cookies for Google Analytics, which collects general or anonymous statistical data, and for Google Adwords analytical tools to support promotional and marketing activities in the retargeting process.

 

7.11. Users can find detailed information on the use of cookies in their web browser settings.

 

 

8. FINAL PROVISIONS

 

8.1. This Privacy Policy enters into force on January 23, 2024.
